Terms of service

Terms & Conditions

Forever Engraved is a trading name of Winelover Limited.

These Terms & Conditions apply to all purchases made through the Forever Engraved website.

By placing an order through our website, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them.

1. About Us

Forever Engraved is a trading name of Winelover Limited, an Irish registered company.

Throughout these Terms & Conditions, references to “Forever Engraved”, “we”, “us” or “our” refer to Winelover Limited trading as Forever Engraved.

References to “you” or “your” refer to the customer placing an order through our website.

Our contact details are provided on our website and should be used for all customer enquiries, order queries and complaints.

2. Our Products

Forever Engraved specialises in personalised and engraved glassware.

Each personalised product is individually prepared and engraved according to the personalisation details supplied by the customer when placing an order.

Product photographs are provided for illustrative purposes. Due to the nature of glassware, individual items may have minor variations in shape, thickness, colour, texture or finish.

Engraving is a permanent process. The appearance of engraving can vary slightly depending on the characteristics of the individual glass and the engraving design.

3. Personalisation

It is the customer's responsibility to ensure that all personalisation details supplied when placing an order are correct.

This includes, but is not limited to:

  • Names

  • Dates

  • Messages

  • Spelling

  • Capitalisation

  • Numbers

  • Other personalised information

We will generally reproduce the information supplied by you and are not responsible for errors contained in the personalisation information provided by the customer.

Please check your personalisation carefully before completing your purchase.

Once engraving has commenced, changes to the personalisation may not be possible.

4. Acceptance of Orders

Placing an order through our website constitutes an offer to purchase the selected products.

An order confirmation will normally be sent to the email address supplied by you.

We reserve the right to decline or cancel an order where, for example:

  • A product is unavailable

  • There is an obvious pricing or product description error

  • The requested personalisation is inappropriate, unlawful or technically unsuitable for engraving

  • We are unable to fulfil the order for reasons outside our reasonable control

If we cancel an order after payment has been taken, you will receive a refund of the amount paid for the cancelled order.

5. Prices & Payment

All prices displayed on our website are stated in euro (€) and include VAT where applicable.

Delivery charges, where applicable, will be displayed before you complete your purchase.

Payment must be made at the time the order is placed.

We use third-party payment providers to process payments. We do not normally have access to your full payment card details.

6. Engraving & Production

Personalised products are produced specifically for the customer and are not normally suitable for resale.

We aim to produce orders accurately and to a high standard. While we make every reasonable effort to ensure that the finished engraving matches the design and personalisation supplied, minor variations can occur as a result of the engraving process and the characteristics of individual pieces of glass.

Where an engraving is genuinely defective due to an error in our production process, please contact us as soon as possible.

7. Delivery

We use An Post and other delivery services where appropriate to deliver orders.

Delivery times displayed on our website are estimates and are not guaranteed delivery dates, unless expressly stated otherwise.

Delivery times can vary depending on order volumes, weekends, public holidays, seasonal demand and other circumstances.

Seasonal variations apply, particularly during periods of high demand such as Christmas, Valentine's Day, Mother's Day, Father's Day and other significant gifting periods.

Once an order has been dispatched, delivery is dependent upon the postal or courier service. Forever Engraved is not responsible for delays caused by An Post or other third-party delivery providers, including delays arising from increased postal volumes, operational disruption, weather, industrial action or other circumstances outside our reasonable control.

If your order has been dispatched but is delayed in transit, we will assist in making reasonable enquiries with the delivery provider where appropriate.

Delivery estimates should therefore be considered when placing an order, particularly where the product is required for a specific occasion or date.

Nothing in these Terms & Conditions affects your statutory rights where goods are not delivered within the timeframe required by applicable consumer law.

8. Delivery Address

Customers are responsible for providing an accurate and complete delivery address.

Forever Engraved cannot accept responsibility for delivery problems caused by an incorrect or incomplete address supplied by the customer.

Please check your delivery information carefully before completing your order.

9. Cancellation, Returns & Refunds

Because our products are personalised and individually engraved, special rules apply to cancellation and returns.

Cancellation Before Engraving

You may request cancellation of your order before your glass has been engraved.

Where cancellation is requested before engraving has commenced, we will provide a refund to the original payment method.

Once engraving has commenced, cancellation due to a change of mind will generally not be possible because the product has been personalised specifically for you.

Personalised Products

Once engraving has commenced, we cannot normally accept cancellation, return or refund requests simply because you have changed your mind.

This includes dissatisfaction with a correctly completed personalisation, changes of mind regarding the design, or incorrect personalisation details supplied by the customer.

Engraving Faults

If your glass has a genuine fault resulting from our engraving process, please contact us as soon as possible and provide photographs showing the issue.

Where an engraving fault is confirmed, our standard remedy is to provide a replacement glass engraved correctly, free of charge, rather than issuing a refund.

Where a faulty item needs to be returned, we will provide appropriate instructions and, where applicable, arrange or cover the reasonable cost of returning the faulty item.

Damaged or Incorrect Items

If your order arrives damaged, or you receive an item that is materially different from the product ordered, please contact us as soon as possible with your order number and photographs of the item and packaging.

We will investigate the matter and, where appropriate, arrange a replacement.

Damage in Transit

All items are carefully checked and securely packaged before leaving Forever Engraved. However, despite our best efforts, damage may occasionally occur during delivery. Any damage in transit must be reported to us within 24 hours of receiving your order, together with details and, where possible, photographs of the damaged item and packaging. Damage reported outside this timeframe will be assumed to have occurred while the goods were in the possession of the customer and may not be accepted as a transit damage claim.

Statutory Consumer Rights

Nothing in this policy is intended to exclude, restrict or limit any statutory rights you may have under Irish or applicable EU consumer law.

Where a product is faulty, does not conform to the contract, is not as described, or otherwise gives rise to a statutory remedy, your legal rights remain unaffected.

10. Personalised Goods & Change of Mind

Personalised goods may be excluded from the standard statutory cancellation right that applies to many online purchases where the goods are made to the consumer's specifications or are clearly personalised.

Where a statutory cancellation right does apply, nothing in these Terms & Conditions is intended to remove that right.

Our policy regarding personalised and engraved products is therefore intended to operate alongside, and not replace, applicable consumer protection legislation.

11. Faults & Product Issues

If you believe that there is a problem with your product, please contact us promptly.

Please provide:

  • Your order number

  • A description of the issue

  • Photographs of the product where appropriate

We will assess the issue and determine the appropriate remedy in accordance with these Terms & Conditions and applicable consumer law.

Where a replacement is appropriate, we will endeavour to provide the replacement as quickly as reasonably possible.

12. Events Beyond Our Control

We will not be responsible for failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • Severe weather

  • Natural disasters

  • Fire

  • Flood

  • Industrial disputes

  • Postal or courier disruption

  • Transport disruption

  • Government restrictions

  • Significant supply-chain disruption

  • Technical failures

  • Other events outside our reasonable control

Where such circumstances occur, we will make reasonable efforts to minimise any resulting delay or inconvenience.

13. Website Information

We make reasonable efforts to ensure that the information displayed on our website is accurate and up to date.

However, occasional errors may occur, including errors relating to product descriptions, availability, prices, images or delivery information.

Where an obvious error is identified, we reserve the right to correct the error and, where necessary, contact customers affected by it.

14. Intellectual Property

All content appearing on the Forever Engraved website, including photographs, graphics, logos, designs, text, branding and other materials, is owned by or licensed to Winelover Limited unless otherwise stated.

Such material may not be copied, reproduced, distributed, modified or commercially exploited without our prior written permission.

15. Customer-Supplied Content

Where customers provide photographs, text, logos, artwork or other material for personalisation or engraving, the customer confirms that they have the necessary rights and permissions to use that material.

The customer must not provide material that infringes another person's intellectual property rights or is unlawful.

We reserve the right to refuse personalisation requests where we reasonably believe that the supplied material is unlawful, offensive or infringes the rights of a third party.

16. Privacy

Personal information supplied when placing an order will be handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information.

17. Complaints

We aim to resolve any problem quickly and fairly.

If you have a complaint regarding an order, product, engraving or delivery, please contact us with your order number and details of the issue.

We will review the complaint and work with you to reach an appropriate resolution.

18. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for fraud, or any statutory consumer rights that cannot legally be excluded or restricted.

Subject to this, we will not be responsible for indirect or consequential loss arising from the use of our website or products where such liability can lawfully be excluded.

19. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

Any disputes will be subject to the jurisdiction of the Irish courts, subject to any mandatory consumer rights or jurisdictional protections that may apply to you under applicable law.

20. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your purchase will be the version displayed on our website at the time your order is placed.

21. Contact

If you have any questions about these Terms & Conditions, your order, delivery, engraving or returns, please contact Forever Engraved through the contact details provided on our website.
